1. Acceptance of Terms

By accessing or using TraceLog's web analytics service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

TraceLog provides web analytics software with AI-powered insights. The Service allows you to track website visitor behavior, analyze user interactions, and generate natural language insights about your website's performance.

3. Account Terms

3.1 Account Creation

• You must be at least 16 years old to use this Service
• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account and password
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are solely responsible for the data you collect through TraceLog and must ensure compliance with all applicable privacy laws (GDPR, CCPA, etc.) when tracking your website visitors.

4. Pricing and Payment Terms

4.1 Subscription Plans

TraceLog offers the following subscription tiers:

• Free: €0/month - 10,000 events/month, 30-day retention
• Starter: €49/month - 100,000 events/month, 60-day retention
• Growth: €149/month - 500,000 events/month, 90-day retention
• Business: €299/month - 1,000,000 events/month, 1-year retention

4.2 Billing

• Paid plans are billed monthly in advance
• All fees are in Euros (€) unless otherwise stated
• You authorize us to charge your payment method on file
• Failed payments may result in service suspension
• Prices are subject to change with 30 days' notice

4.3 Usage Limits

If you exceed your plan's monthly event limit, new events will be rejected until the next billing cycle or you upgrade your plan. We will notify you when you reach 80% and 100% of your limit.

4.4 Refunds

We offer a 14-day money-back guarantee for first-time subscribers. Refunds for subsequent months are evaluated on a case-by-case basis. No refunds for partial months or unused portions of annual plans.

5. Cancellation and Termination

5.1 Cancellation by You

• You may cancel your subscription at any time from your account dashboard
• Cancellation is effective at the end of your current billing period
• You retain access to paid features until the end of the paid period
• Your data will be retained according to your plan's retention policy after downgrading to Free

5.2 Termination by TraceLog

We may terminate or suspend your account immediately, without prior notice, if you:

• Breach these Terms of Service
• Violate our Acceptable Use Policy
• Engage in fraudulent or illegal activity
• Fail to pay outstanding fees

6. Acceptable Use Policy

You agree NOT to use TraceLog to:

• Track websites you do not own or have permission to track
• Collect or store sensitive personal data without proper consent (health data, financial data, etc.)
• Violate any applicable laws or regulations
• Reverse engineer, decompile, or attempt to extract the source code
• Use the Service to send spam or malicious content
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Resell or redistribute the Service without written permission

7. Intellectual Property

7.1 TraceLog's IP

The Service and its original content, features, and functionality are owned by TraceLog and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Your Data

You retain all rights to the data you collect through TraceLog. We do not claim ownership of your analytics data. You grant us a limited license to process and display your data to provide the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

9. Service Availability and Support

9.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted availability. We may perform scheduled maintenance with advance notice.

9.2 Support

• Free plan: Email support (best effort)
• Paid plans: Priority email support (24-48 hour response time)
• Business plan: Priority support with faster response times

10. Disclaimers and Limitation of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACELOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO TRACELOG IN THE LAST 12 MONTHS, OR €100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless TraceLog, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or dashboard notification at least 30 days before they take effect. Your continued use of the Service after changes constitute acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Madrid, Spain.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TraceLog regarding the use of the Service and supersede all prior agreements and understandings.
